1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the fertigroww website, learning portal, programmes, and related services (the "Services"). By accessing the website, submitting an application, or enrolling in a programme, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. About fertigroww

fertigroww provides educational and advisory programmes — including fertigroww Blueprint (for founders building their first ART (IVF) centre) and fertigroww Accelerator (for existing clinic owners) — focused on business, systems, and operations. Our programmes are practitioner-led and delivered to a limited cohort each intake.

3. Eligibility

The Services are intended for owners, founders, and professionals involved in establishing or running ART (IVF) clinics. They are not intended for patients seeking fertility treatment. You confirm that you are at least 18 years of age and have the authority to accept these Terms.

4. Applications, Enrolment, and Cohorts

Submitting an application does not guarantee a place. Seats in each cohort are limited and admission is at our discretion. We will confirm your programme and eligibility before enrolment. We may modify the schedule, structure, faculty, or delivery format of a programme where reasonably necessary, while preserving its overall value.

5. Fees and Payments

Programme fees are communicated on enquiry. Unless stated otherwise, fees are exclusive of applicable taxes, which will be added as required by law. Payments are processed through third-party payment gateways; by paying, you also agree to their terms. Access to programme materials may be conditional on full payment.

6. Refunds and Cancellations

Any refund or cancellation terms applicable to a specific programme or cohort will be communicated to you in writing at the time of enrolment and will govern that enrolment. In the absence of specific terms, fees paid are non-refundable once programme access has been granted, except where required by law.

7. Intellectual Property

All programme materials — including frameworks, templates, SOPs, playbooks, recordings, and documentation — are the intellectual property of fertigroww or its licensors and are provided to you under a limited, non-exclusive, non-transferable licence for your own clinic's internal use. You may not copy, resell, redistribute, publish, or share these materials, or use them to create a competing programme, without our prior written consent.

8. Acceptable Use

You agree to keep your account credentials confidential, to use the Services lawfully, and not to disrupt, reverse-engineer, or attempt unauthorised access to the Platform. You are responsible for activity under your account. We may suspend or terminate access for breach of these Terms.

9. No Professional Advice; Compliance Is Your Responsibility

Our programmes provide general business, systems, and operational guidance for ART (IVF) clinics. They do not constitute medical, clinical, legal, financial, tax, or regulatory advice. You remain solely responsible for your clinic's compliance with all applicable laws and regulations — including the Assisted Reproductive Technology (Regulation) Act and related rules, medical and clinical standards, and licensing requirements — and should obtain independent professional advice where appropriate.

10. No Guarantee of Results

While our programmes are designed to help you build and grow a stronger clinic, outcomes depend on many factors outside our control, including your execution and market conditions. We do not guarantee any specific business, financial, or clinical result.

11. Cohort Conduct and Confidentiality

To protect peer learning, you agree to keep confidential any non-public information shared by other participants within a cohort, and to engage respectfully. We may remove participants who breach this expectation.

12. Third-Party Services and Links

The Services may rely on or link to third-party tools (such as messaging, video, and payment providers). We are not responsible for the content, policies, or practices of third parties, and your use of them is governed by their own terms.

13. Limitation of Liability

To the maximum extent permitted by law, fertigroww shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or business, arising from your use of the Services. Our total aggregate liability for any claim shall not exceed the fees you paid to us for the programme giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless fertigroww, its team, and partners from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of the Services, or your clinic's operations.

15. Termination

We may suspend or terminate your access to the Services if you breach these Terms or for operational or legal reasons. Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, and limitation of liability — will continue to apply.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts of India shall have jurisdiction over any disputes arising from these Terms or the Services.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date, and your continued use of the Services after changes take effect constitutes acceptance.
